Agenda:

1. The majority of Americans who rely on nutritional supplementation escaped government smothering of the industry when Senator Richard Durbin’s (D-IL) annual attacks on nutraceuticals were defeated in Congress – with the aid of NHF’s advocacy. Health-freedom advocates have high hopes for supplements with Trump’s HHS under the control of RFK, Jr. He’s said that he wants to end FDA’s pHARMa-goaded persecution of natural care, but also he wants to end a loophole that could end up subjecting vitamin formulas to bankrupting, drug-like approval requirements. The loophole is the “Generally Recognized As Safe” (GRAS) process under which mostly packaged food companies have inserted toxic ingredients to processed foods without having to get FDA additive approval as required under a 1958 law. Nutritional companies have used this loophole instead of the process made for them under the 1994 Dietary Supplement, Health and Education Act (DSHEA), under which manufacturers are supposed to submit notice of new ingredients. Supplement lobbyists have responded that the FDA isn’t sufficiently exercising current enforcement authority, and thus shouldn’t be granted new powers that would have unintended consequences as described above. NHF Board member Matt Warnock, as a lawyer and company owner, takes a more philosophic approach in insisting on a debate over the ability of FDA ever to properly regulate food and supplements. Every human’s health is unique, Matt likes to say, and the bell curve of treatment response implies an impossibility of one-size-fits-all regulation. Thus, do we need to consider more fundamental reforms?
2. Unfortunately, pHARMa’s propaganda that nutritional supplements enjoy a “Wild West” market has proved effective, as politicians find a ready audience for knee-jerk bills to slap new regulations oblivious to the law of unintended consequences. Unhindered for the time being by bankrupting, pHARMa-like pre-approval requirements, manufacturers and nutritional experts are able to recommend an extremely-wide variety of supplement recommendations to clients and patients. Reputation, then, gets to show its superiority to regulation in educating the masses on what vitamin formulas work. Experts are able to argue, and customers experiment, creating a race to the top. Mr. Hommel has organized the community of Americans taking high doses of the copper nutrient, even while other experts discount the safety or efficacy of this approach. NHF welcomes experts to rejoin this debate, which will expand to a discussion of what nutrients are best for which symptoms. So bring your complaints and see what the experts recommend!
